These Terms of Service ("Terms") are a binding agreement between you and the operator of the Sunaad mobile application ("Sunaad", the "App", "we", "us"). By installing, accessing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, e.g. 16 in parts of the EEA) to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement of a parent or guardian who agrees to these Terms.
2. What Sunaad is
Sunaad is a directory and media player that helps you discover and play publicly available internet radio streams and podcast feeds. We do not host, own, control, create, broadcast or endorse the audio content, streams, feeds, logos or trademarks made accessible through the App. We index links and metadata and relay streams provided by third-party broadcasters, podcast hosts and creators ("Content Providers").
3. Third-party content — disclaimer
All stations, shows, episodes, artwork, names and trademarks belong to their respective owners. The App acts as a conduit, similar to a web browser or podcast player. We are not responsible for the availability, accuracy, legality, quality or content of any third-party stream or feed, including any advertising, opinions, or material that may be offensive, inaccurate or objectionable. Your dealings with Content Providers are solely between you and them. Geographic or licensing restrictions imposed by a Content Provider are theirs; we do not provide tools to circumvent any such restriction.
4. Licence to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use. You may not: copy, modify, reverse-engineer, decompile or disassemble the App except to the extent permitted by law; rent, lease, sell, sublicense or distribute it; remove proprietary notices; use it to build a competing product; or use automated means to access, scrape or overload the App or the streams.
5. Acceptable use
You agree not to use the App to: violate any law or third-party right; infringe intellectual property; distribute malware; harass, abuse or harm others; submit false, misleading, infringing or unlawful content; interfere with or disrupt the App, its servers, or the streams; or attempt to gain unauthorised access to any system or account. You are responsible for your conduct and for complying with all applicable laws, including road-safety laws — never operate the App or Car Mode in a way that distracts you while driving.
6. Content you submit (claims, submissions, reports, feedback)
The App lets you submit material — ownership claims, content (station/podcast) submissions, problem reports and feedback ("User Content"). You represent that you have the right to submit it and that it is accurate and lawful. You grant us a worldwide, royalty-free, non-exclusive licence to use, store, reproduce and process your User Content to operate, review and improve the App and to respond to you. We are under no obligation to publish, act on, verify, or include any submission in the catalogue, and we may remove or decline any submission at our discretion. Submitting a request creates no partnership, employment or other relationship.
7. Copyright & takedowns (DMCA-style)
We respect intellectual property and respond to valid notices. If you are a rights holder and believe content accessible through the App infringes your rights, or you want your station/feed corrected, attributed differently or removed from the directory, email lctsgamehub@gmail.com with: (a) your contact details; (b) identification of the work and the specific item/URL at issue; (c) a statement that you have a good-faith belief the use is unauthorised; (d) a statement, under penalty of perjury where applicable, that the information is accurate and you are authorised to act; and (e) your signature (electronic is fine). We will act promptly on valid notices, including by removing or geo-limiting the item, and we terminate the listings of repeat infringers. Our designated contact for copyright notices is lctsgamehub@gmail.com (subject: "Copyright Notice"). If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address with the equivalent identifying information.
8. Accounts
You can use Sunaad as a guest. If you sign in with Google, you are responsible for activity under your account and for keeping access secure. You may delete your account at any time from Settings → Delete Account. We may suspend or terminate accounts that violate these Terms.
9. Ads, rewards & voluntary support
The App is funded by ads, shown subject to the consent choices described in our Privacy Policy. The optional Reward Center lets you watch an ad in exchange for temporary ad-free time; reward terms may change. Any voluntary support or donation you choose to give is not a purchase of goods or services, confers no rights or benefits, and is non-refundable except where required by law.
10. Third-party services
The App relies on third-party services (including Google Firebase, AdMob and Google Sign-In) and links to third-party streams and websites. Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or content.
11. Disclaimers — "AS IS"
To the maximum extent permitted by law, the App and all content and streams are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the App or any stream will be uninterrupted, timely, secure, error-free, available in your location, or that any particular station or episode will be available, accurate or lawful. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, in no event will the operator, its contributors or providers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the App or any third-party content, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of (a) the amount you paid us to use the App in the 12 months before the claim (which for most users is zero), or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for fraud, or death or personal injury caused by negligence), and your mandatory statutory consumer rights are unaffected.
13. Indemnification
You agree to indemnify, defend and hold harmless the operator and its contributors and providers from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to: your use of the App; your User Content; your violation of these Terms or any law; or your infringement of any third-party right.
14. Termination
You may stop using the App at any time by uninstalling it. We may suspend, restrict or terminate your access to the App (in whole or in part) at any time, with or without notice, including if we believe you have violated these Terms or to comply with law or protect the service. Sections that by their nature should survive termination (including §§3, 6–7, 11–13, 16–18) will survive.
15. Changes to the App and Terms
We may modify, suspend or discontinue the App or any feature at any time. We may also update these Terms; the "Last updated" date will change and, where appropriate, we will provide notice. Continued use after an update constitutes acceptance of the revised Terms.
16. Informal dispute resolution (required first step)
Before starting any arbitration or court proceeding, you agree to first contact us at lctsgamehub@gmail.com with a short description of the dispute and your contact details, and to try in good faith to resolve it informally for at least 30 days. This is a condition before any formal proceeding.
17. Governing law & jurisdiction
These Terms are governed by the laws applicable in the place where the operator of Sunaad is established, without regard to conflict-of-law rules and without prejudice to any mandatory consumer-protection rights you have under the laws of your country of residence. Except where §18 (arbitration) applies, any dispute not resolved informally will be subject to the courts of the operator's place of establishment, save that you may also bring proceedings in your local courts where applicable law gives you that right.
18. Arbitration & class-action waiver (U.S. residents)
This section applies if you are a resident of the United States, to the fullest extent permitted by law. Please read it carefully — it changes how disputes are resolved and limits class actions.
- Binding individual arbitration. Any dispute, claim or controversy arising out of or relating to the App or these Terms that is not resolved informally will be settled by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as stated below. The Federal Arbitration Act governs this section.
- Class-action & jury-trial waiver. Proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action, and you and we waive any right to a jury trial.
- Exceptions. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for infringement or misuse of intellectual property or for unauthorized access to the service.
- 30-day opt-out. You may opt out of this arbitration agreement by emailing lctsgamehub@gmail.com with the subject line "Arbitration Opt-Out" and your name within 30 days of first accepting these Terms; opting out does not affect the rest of the Terms.
This section does not override the mandatory consumer-protection or dispute-resolution rights of users in the EEA, the UK, or other places where such waivers are not permitted — for those users, §§16–17 apply instead.
19. Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, power or internet outages, or the acts or omissions of third-party providers, broadcasters or networks.
20. Export controls & sanctions
You represent that you are not located in a country subject to a comprehensive government embargo and are not on any government list of prohibited or restricted parties, and you agree to comply with all applicable export-control and sanctions laws when using the App.
21. Apple / Google app-store terms
If you obtained the App from an app store, you also agree to that store's terms. The store is not a party to these Terms and is not responsible for the App or its content; any store-specific obligations (e.g. support and warranty handling) are between you and us, not the store, to the extent permitted by the store's rules.
22. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the App. If any provision is held unenforceable, the rest remains in effect and the unenforceable part will be limited to the minimum extent necessary. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or asset sale. Headings are for convenience only.
